LEGISLATIVE TREATMENT AND LEGAL-POLITICAL ASPECTS OF THE CRIMINAL OFFENCE OF DOMESTIC VIOLENCE IN MONTENEGRO

This paper presents and analyzes the concept and constitutive elements of the criminal
offence of domestic violence or violence within a family community in Montenegro, as a
manifestation of the violation of fundamental rights and freedoms guaranteed by international
law. Special attention is given to the theoretical-legal and positive-legal definitions of
domestic violence. Within this framework, the paper provides an overview of the national
legislation covering the period from 2002 to 2025, illustrated through a chronological review
of the amendments to the Criminal Code of Montenegro. Furthermore, the paper addresses
the legal and policy aspects of domestic violence, as well as specific issues identified in the
practice of the Montenegrin judiciary
